Every applicant to the California State Bar must demonstrate good moral character. For most applicants, the process is uneventful. Attorney Reinstatement
If you have been suspended or disbarred in California and are working toward returning to practice, reinstatement requires petitioning the State Bar and demonstrating that you have been rehabilitated, possess good moral character, and are competent to practice law. It is not an automatic process — it requires substantial preparation, careful documentation, and in many cases a formal hearing before the State Bar Court.
The reinstatement timeline in California typically runs 12 to 24 months or longer from the time a petition is filed, depending on the severity of the original discipline and the strength of the rehabilitation evidence. For disbarment, there is a minimum five-year waiting period. For attorneys who voluntarily surrendered their license with charges pending, there is also a minimum five-year waiting period before a petition can be filed.
